1. Basis of Terms & Conditions GOVERNING JURISDICTION This Legal Notice shall be governed by and construed in accordance with English law. Any dispute(s) arising in connection with this Legal Notice are subject to the exclusive jurisdiction of England and Wales.

1.1 The supply of goods by 'SaveOnSpecs' is subject to English Law under the Sale of goods Act 1979.

1.2 The customer’s contract is made with Stewart Clough trading as www.SaveOnSpecs.co.uk

1.3 Your order and acceptance of the Terms & Conditions will constitute a legal agreement. Our acceptance of this order and delivery of the goods will form a legal binding contract between Stewart Clough T/A www.SaveOnSpecs.co.uk and you the customer.

2. Supply of Goods.

2.1 The products on our website are presented as accurately as possible given the limits of photographic, website design and graphic techniques. We indicate sizes and colours as clearly as possible.

2.2 All goods are sold subject to their availability.

2.3 We will not supply glasses to customers who are registered blind or partially sighted.

2.4 We do not supply complex prescriptions; defined as a prescription with a power greater than 10 Dioptres Sphere in any meridian.

2.5 We are not permitted to sell spectacles to children under the age of 16. By accepting these terms and conditions you are confirming that you are over 16 years of age.

2.6 The prescription must be less than 2 years old and have been provided by a registered Optometrist following an eye examination.

2.7 It is the obligation of the customer to correctly enter the prescription information from which the lenses will be produced into our information fields, if any help or guidance is required it is up to the customer to contact us by e-mail or phone.

2.8 We recommend that you obtain your PD or interpupillary distance from your optician. Failing this you should either have a friend measure it or measure it yourself as shown in the guide on this site. If you chose to select the default setting we shall use a measurement of 64 and 62 for distance spectacles for men and women respectively and a near inset of 4mm.

3. Price.

3.1 The prices shown on this website are inclusive of VAT at the standard rate of 15%.

3.2 The prices on this website are correct at the time of use.

3.3 We reserve the right to adjust the prices of our products as we see fit without prior notification.

3.4 Once an order has been placed by a customer the price agreed is fixed and not subject to any prices changes of other products on this site.

4. Payments.

4.1 The site follows a logical buying process. Select the frame you wish to buy and then select any lens options such as thinner lenses or tints. When you have completed your order you will need to click the Checkout tab. This will take you to a secure area where you will enter private information, prescription details and banker’s card details.

5. Credit Card Security Your purchase payments are handled by HSBC Bank if you chose to use a bankers card or by PayPal, if you that option. The shopping cart uses advanced encryption technology and at no point do we see or record your card details.

6. Availability of Stock If the glasses you have chosen are out of stock, we will order them for you from our suppliers. You will be informed by e-mail if we need to do this and you will retain the right to cancel the order if you prefer not to wait.

7.Delivery

7.1 We shall deliver your glasses within 28 days subject to stock levels and assuming that neither our suppliers nor ourselves incur difficulties in the making of your glasses.

7.2 We can supply your goods to any postal address in the world that the Royal Mail can deliver to.

7.3 The prices shown on this website do not include delivery.

7.4 The customer is obliged to supply the correct delivery address details when placing an order, we reserve the right to only supply to addresses that correspond to the billing address.

8.Cancellation & Returns.

8.1 The customer has the right to cancel any order within 7 days of the order having been accepted by 'SaveOnSpecs', assuming that the glasses have not been delivered within this time.

8.2 On receipt of goods at the address specified in your order the responsibility for and risk of damage to the goods shall pass to you.

8.3 Once completed, your order will be carefully inspected before leaving our workshop. When you receive your goods, please check them and inform us immediately if they are damaged. If they are, please return them to us within 14 days and we will supply you with another identical product.

8.4 The customer's delivery will contain a copy of the prescription to which the glasses have been made. If for any reason this does not tally with your optician’s prescription details do not use the glasses and contact us immediately. If, after speaking to us, we have any doubts concerning the prescription of the glasses, return them to us with either your optician’s original prescription or a photocopy of it. If we have made a mistake in the glazing of a customer's lenses, we rectify the mistake and return the corrected product to the customer. If however we are unable to make the glasses to the required prescription we shall give the customer a full refund.

8.5 The cost of delivery and or insurance is non-refundable 8.6 Your rights to return goods are protected under the EU Distance Selling Directive which can be found at http://www.hmso.gov.uk/si/si2000/20002334.htm

10. Privacy Policy SaveOnSpecs do not disclose buyers' information to third parties other than with a postal service so that your goods can be delivered. Our delivery agent, a third party, will not disclose any of the details to any other third party. Our website uses cookies to keep track of the contents of your shopping cart, to store delivery addresses if the address book is used and to store your details for future orders. They are also used after you have logged on as part of that process. You can turn off cookies within your browser by going to 'Tools / Internet Options / Privacy' and select ‘block cookies’. If, however, you turn the cookies function off, you will be unable to place orders or benefit from the other features that use cookies. Cookies are only used for the efficient working of the website and your convenience.

11.Liability.

11.1 Goods purchased from our site are subject to English Law only.

11.2 Nothing in these terms and conditions is to be taken to exclude or restrict any rights which applicable law grants to you in respect of such goods. Individual goods may be the subject of additional warranties or guarantees given by their manufacturers directly to you.

11.3 We shall not be liable to any person for any damage or loss that may arise from the use of any goods displayed on our site.

11.4 We do not accept any responsibility and will not be liable for any damage to the goods caused by you.

11.5 Without prejudice to your statutory rights, all the information and materials contained in this site (including, without limitation, text, graphics and links) are provided on an "as is" basis with no warranty and in particular, we do not represent or warrant that the information accessible via this site is accurate, complete or current or that the use of this site will be uninterrupted or error-free.

11.6 Notwithstanding anything else in these terms and conditions, in relation to any one event or series of events relating to the purchase of any goods from the ’SaveOnSpecs’ web site, we will not be liable for:

(i) claims relating to the availability of the 'SaveOnSpecs' range, the ’SaveOnSpecs’ web site, points of purchase, or the success or level of sales resulting there from;

(ii) any indirect, incidental or consequential damages or lost profits.

11.7 Neither the buyer or the seller shall be liable to the other or be deemed to be breach of contract by reason of any delay in performing or any failure to perform, any of it obligations in relation to the goods, if the failure was beyond that parties control i.e.; act of God, explosion, flood, fire or accident. War or threat of war, sabotage, or insurrection. Change in Acts, restrictions, regulations or bye-laws. EXCLUSION OF LIABILITY

11.8 Neither we nor any other party (whether or not involved in producing, maintaining or delivering this Website), shall be liability or responsible for any kind of loss or damage that may result to you or a third party as a result of your or their use of our website. This exclusion shall include servicing or repair costs and, without limitation, any other direct, indirect or consequential loss, and whether in tort or contract or otherwise in connection with this Website. Nothing in these Terms shall exclude or limit liability for

(i) death or personal injury caused by our negligence or the negligence of our servants and agents in the course of their duty (as defined by the Unfair Contract Terms Act 1977);

(ii) fraud;

(iii) misrepresentation as to a fundamental matter; or

(iv) any liability which cannot be excluded or limited under the law of the United Kingdom.

12.0 Returns Policy Please see clauses 8.3, 8.4 and 8.5 Returns for exchange or reglazing should be posted to: SaveOnSpecs 33 The Parade Swinton M27 4BH Please e-mail us quoting your order number before returning products to us detailing why they are being returned.

12.1 Faulty Products and Incorrect Orders If your new glasses are faulty in any way or not as you ordered them, please e-mail us at admin@saveonspecs.co.uk quoting your order number, your name and address, details of the product and the reason for return . We will then advise on how to proceed with the return.

12.2 Discount codes & vouchers If a discount was applied to your original order, the amount refunded will be the amount that you actually paid for the goods after any discounts.

12.3 This returns policy does not affect your statutory rights.

12.4 If we are unable to correct any issues arising from the manufacture or supply of your goods we shall refund you. Once a refund has been authorised please allow five working days for us to process your refund before contacting us further.

12.5 A refund will only be credited to the card that was originally used to pay for the order. If this is not practical due to the loss or expiration of the card we shall post a cheque to the cards billing address within 5 working days.

12.6 Once a refund is processed you will receive an e-mail informing you as such at the same e-mail address that we used to confirm your order. Once you have received this e-mail, please allow another 5 to 10 working days for the refund to be credited to your bankers card. This timescale is dependent on you bank and we have no control over it.

12.7 Missing parts If you find that your order is incomplete and part of it is missing please e-mail us at: admin@SaveOnSpecs.co.uk quoting your order number and telling us what is missing and we shall investigate the matter further.

12.8 Exchanges Normally it takes us a week to ten days to process an exchange, providing that we have the necessary items in stock. Please allow for this time frame to pass before contacting us for a delivery update.

12.9 Delivery Service We shall deliver your goods by Royal Mail recorded delivery. The postal service could take up to a week to deliver your goods.

12.10 Returning Goods and Postage Returned goods remain your responsibility until they reach us. It is in your best interest that we recommend that you send goods back to us in a padded, crush resistant container and use a delivery service that insures you for the value of the goods. If the item you received is faulty or is not what you originally ordered, please e-mail admin@SaveOnSpecs.co.uk quoting your order number, your name, address and details of the product. We will then advise on how to proceed with the return.

 Delivery charge Refund Policy

If you are returning the goods to us because of an act or omission on our part we shall refund you the reasonable cost of returning the goods to us. If you are returning goods to us for an exchange or for any reason for which we are not culpable then the cost of returning the item to us is non-refundable. Tel 0161 794 3532
